Tripartite is an International Treaty: So, Dr Gaima’s Signature or Not Makes No Difference as the Majority Carries the Vote

The SLPP Co-Chair on the Tripartite Committee Dr Emmanuel Gaima is doing more disservice to the SLPP regime as well as damaging his own reputation.
And by consistently refusing to sign the latest document presented by the Tripartite Investigations Committee in order to facilitate the cooperation of the controversial Electoral Commission for Sierra Leone ECSL, it is at best unfortunate and at worst damaging his own hard-earned reputation by contravening the International Treaty that born the Tripartite Committee. The Tripartite Committee has demanded the ECSL to release the disaggregated data but this could be facilitated and made possible smoothly if all three signatures of the Co-Chairs on the Committee are appended. That is why Dr Gaima’s signature is significant because it would hasten the release of the ECSL disaggregated data sooner and smoothly. This vital Communique was not only signed in Freetown on October 18, 2023 but it was also endorsed by ECOWAS in Abuja, by African Union in Addis Ababa, endorsed in New York by the United Nations Security Council.
The two other Co-Chairs from the main opposition APC party and the United Nations representing the international community have both appended their signatures on the documents requesting the ECSL to submit the disaggregated data of the June 24, 2023 elections. The corrupt ECSL Chairman Mohamed Kenewui Konneh has already submitted the doctored and fake elections results that he used to declare Maada Bio as President. But the Tripartite Secretariat led by the Kenyan Judge Justice Msangha Mbogholi is still waiting for the disaggregated data from ECSL, the most important electoral document in the fraudulent June 24, 2023 general elections which Maada Bio stole from the actual winner Dr Samura Kamara of the APC party. This vital Communique was not only signed in Freetown on October 18, 2023 but it was also endorsed by ECOWAS in Abuja, by African Union in Addis Ababa, endorsed in New York by the United Nations Security Council.
The APC Co-Chair Dr Keifala Marah and the UN Co-Chair Madam Seraphine Wakana have already signed the document, but the ECSL is dragging its feet to present the disaggregated data simply because of the reluctance of Dr Gaima to cooperate. Sources say his boss Maada Bio has strongly warned Mohamed Konneh not to release the disaggregated data at any costs. And Dr Gaima is under pressure not to facilitate the release of the data. This vital Communique was not only signed in Freetown on October 18, 2023 but it was also endorsed by ECOWAS in Abuja, by African Union in Addis Ababa, endorsed in New York by the United Nations Security Council.
It is disappointing if Dr Gaima decides to show stubbornness because it would damage his own reputation. And most importantly, the ECSL would still be forced to release the disaggregated data as long as the two signers have signed the document. And in the event that Mohamed Konneh refused to comply, the Tripartite Committee will go ahead to make its recommendations with or without the data and will be implementable and actionable. So, in whatever way Dr Gaima looks at it, the SLPP Co-Chair needs to be careful as breaching international law is detrimental to him and the Bio presidency. What is International Treaty? Wikipedia defines it as: “A treaty is an international agreement concluded in written form between two or more States (or international organisations) and is governed by international law. A treaty gives rise to international legal rights and obligations. What is the purpose of a treaty in international law? Treaty, a binding formal agreement, contract, or other written instrument that establishes obligations between two or more subjects of international law (primarily states and international organizations).

From all indications, the Tripartite shall succeed. Dr Gaima’s signature does not matter whether he signs or not as the majority carries the vote. The Tripartite is untouchable. After all, both Dr Marah and Madam Wakana have signed the document. The recalcitrance of the SLPP Co-Chair Dr Emmanuel Gaima is bad news for himself and the Maada Bio. Dr Gaima is risking his own life for refusing to sign the document to probe ECSL. The Sierra Leone electorates are waiting to celebrate whether Dr Gaima signs or not. Now, it is the turn of the SLPP Co-Chair Dr Emmanuel Gaima to sign but he is still refusing to append his signature because Maada Bio does not want him to sign. The document is created by the act of an International Treaty so any of the three party members who refused to sign will make no difference. As long as two members of the three party members have signed, the Committee will go ahead with its work. Why is Dr Gaima so afraid to sign if the Tripartite is in Maada Bio’s favour? His refusal to comply is proof that the Tripartite recommendations will not favour Bio.
